Legal Head on Retainership at Mehta group - Thane

Job Description

In real estate, legal issues can directly impact project timelines, costs, and brand reputation. The Legal Head ensures:

• Smooth project execution
• Reduced legal disputes
• Strong compliance framework
• Manage legal matters related to real estate, property, and corporate law.
• Provide expert advice on non-litigation matters such as land acquisition, lease deeds, MOUs, affidavits, sale deeds, litigation management, dispute resolution.
• Oversee litigation matters from initiation to resolution.
• Legal Compliance & Regulatory Management: Ensure compliance with real estate laws such as Real Estate (Regulation and Development) Act, 2016 (RERA), Monitor changes in local, state, and national property laws, Liaise with regulatory authorities and government bodies, Ensure compliance with relevant laws and regulations governing the real estate industry.
• Land Acquisition & Title Due Diligence: Conduct title searches and verify ownership documents, identify legal risks in land acquisition, Handle conversion of land use (agricultural to non-agricultural, etc.) , Ensure encumbrance-free property transactions.
• Contract Drafting & Negotiation: Draft and vet agreements such as Sale agreements, Joint development agreements (JDAs), Lease agreements, Vendor and contractor contracts, negotiate terms to protect company interests , Draft agreements, contracts, and other legal documents for the company's projects.
• Litigation & Dispute Resolution
• Manage ongoing litigation related to: Property disputes, Customer complaints. Regulatory issues, Coordinate with external lawyers and law firms, Represent or oversee, representation in courts and tribunals
• Project Approvals & Documentation: Ensure all legal approvals are obtained: Land approvals, Environmental clearances, Municipal permissions, Maintain documentation for audits and compliance
• Risk Management & Advisory: Advise senior management on legal risks in projects and investments, develop risk mitigation strategies, Provide legal inputs for business decisions and expansion plans
• Corporate Legal Functions: Handle corporate governance matters, manage board resolutions, shareholder agreements, and compliance, Oversee company policies from a legal perspective

Key Skills Required

• Strong knowledge of property and contract law
• Expertise in land laws, RERA, and municipal regulations
• Negotiation and drafting skills
• Litigation management experience
• Strategic thinking and risk assessment
• Leadership and team management

Experience & Qualification

• LLB / LLM (often preferred)
• 1020+ years of experience in real estate or infrastructure
• Prior experience in handling large-scale projects
